Canal Winchester

    157.03  ESTABLISHMENT AND COMPOSITION.

     (a)     The Landmarks Commission is hereby established, consisting of seven members, who shall be appointed by the Mayor. subject to confirmation of Council, after consulting with the Landmarks Commission and Canal Winchester Area Historical Society.   All potential members nominated shall have demonstrated an interest, experience, or knowledge in historic preservation.

     (b)     At least five members shall be residents of the Municipality. The remaining two members shall be residents or property-owners within the Municipality. Whenever possible, the appointments should be made so the following qualifications are represented by the total membership of the Commission:
          (1)     Four resident/owners of Landmarks or property within the Historic District(s).
          (2)     One owner/manager of a commercial/ industrial business within the Municipality.
          (3)     At least four preservation-related professional members to the extent such professionals are available in the Community. (This shall include the professions of architecture, architectural history, history, archeology, urban planning, landscape architecture, art design, law, education, real estate, and historic preservation or related disciplines.)

     (c)     The Landmarks Commission members shall be appointed to terms of four (4) years each.  To facilitate the continuity of the Landmarks Commission, appointments shall be of either two or three years when necessary to ensure the terms of the members are staggered so that not more than three members are scheduled for appointment or reappointment during any one calendar year.   In the event of a vacancy occurring during the term of a member, the Mayor shall make any interim appointment to serve out the unexpired term within 45 days from the effective date of the vacancy.

Delaware

     1190.03  HISTORIC PRESERVATION COMMISSION (HPC).

     The purpose of the Historic Preservation Commission (HPC) shall be to administer the delegated functions as set forth in this chapter.

     (a)     Appointment and Membership.  The Historic Preservation Commission (HPC) shall be composed of seven (7) members, of which the majority shall be City residents.
          (1)     The members shall be appointed by the Mayor with the consent of Council.
          (2)     The Commission shall include among its members at least one (1) member of City Council.
          (3)     If possible, the Mayor shall attempt to appoint members with the following professional background(s):
               A.     A professional historic preservationist or an historian;
               B.     An architect;
               C.     A real estate agent or a developer; and
               D.     An historic district property owner.
          (4)     Members shall serve without compensation.

     (b)     Term.  Members shall serve for a term of three (3) years.
          (1)     The initial appointments shall be staggered terms in following manner: three (3) members for a three-year term, two (2) members for a two-year term, and two (2) members for a one-year term.
          (2)     Vacancies caused by death, resignation or otherwise shall be filled for the unexpired term in the same manner as original appointments are made.

     (c)     Organization.
          (1)     Within thirty (30) days after appointment and subject to Council approval, the Historic Preservation Commission shall meet and organize by election of a chairperson and vice-chairperson.
          (2)     The HPC shall annually select one of its members to serve as chairperson and one to serve as vice-chairperson.
          (3)     Subject to the approval of the Delaware City Council, the HPC shall adopt rules of procedure, which shall be published and will provide for regular and special meetings of the Commission.
          (4)     The HPC shall adopt rules and regulations consistent with this chapter governing its procedures and transactions. The HPC shall meet as required to carry out the review of applications for certificates of appropriateness, and such other related work as may be accepted or undertaken.

     (d)     Meetings.
          (1)     Meetings shall be held at least once a month when there are applications to be considered and not less than once every three months. Special meetings may be held at the call of the chairperson upon the request of three (3) members of the HPC.
          (2)     The chairperson shall conduct the meetings of the HPC and a record of minutes shall be kept and maintained and available for public inspection for at least six (6) years. All meetings shall be open to the public.
          (3)     Four (4) members of the Commission serving at any given time shall constitute a quorum. For the taking of official action, a majority of the Commission is required.  (Ord.  01-79.  Passed 8-13-01.)


Lancaster

    1327.04  ESTABLISHMENT OF HISTORIC LANCASTER COMMISSION.    
       
     There is hereby established the Historic Lancaster Commission in accordance with this Chapter.

     (a)     The Historic Lancaster Commission shall consist of the required number of members as appointed by the Mayor with the approval of City Council, pursuant to the requirements of Sections 1327.04 (d) below.  Members shall serve without compensation.  The Mayor shall have the authority to appoint alternate members to the Commission, as may be determined appropriate.

     (b)     Appointed members shall be subject to removal for cause by the Mayor.  Vacancies for the remainder of an unexpired term shall be filled by the Mayor, within sixty (60) days from the date of vacancy.   All members shall be residents of the City.

     (c)     All members shall be appointed to three (3) year terms, and the initial term appointments provided for in this ordinance shall be staggered according to the following schedule:
          (1)     Two (2) members shall each be appointed to serve for an initial full term of three (3) years.
          (2)     The third and fourth  members shall each be appointed for a term of two (2) years.
          (3)     The fifth member shall each be appointed for a term on one (1) year.  All terms shall begin on January 1 of the applicable year.

     (d)     Membership.
          (1)     The Commission shall consist of five (5) voting members.  One (1) member of the Commission shall be a member of City Council or a designee of City Council.  Four (4) members shall be appointed by the Mayor with City Council approval.  Three (3) members shall constitute a quorum, and a concurring majority vote by members present shall be necessary for official action. 
          (2)     In appointing  members, the Mayor shall make good faith effort to appoint persons with training in the fields of architecture, design, historic preservation, planning or related disciplines such as construction, commercial or mixed use development, or real estate.  In addition, appointees should possess a demonstrated personal and/or professional interest, experience and knowledge in the preservation of historic structures.
          (3)     The Mayor shall solicit a list of potential nominees for membership on the Commission from organizations such as the Fairfield Heritage Association, Lancaster Special Improvement District, and Main Street Lancaster.   Such list shall document the qualifications of potential nominees and shall be updated/revised on an annual basis.  The Mayor shall review and consider such recommendations in appointing new members to the Commission.

Medina

     145.03  BOARD MEMBERSHIP.

     The Historic Preservation Board shall consist of five members who shall demonstrate a special interest, knowledge, or training in preservation, architecture, history, planning, conservation, landscape architecture, archeology, urban design or closely related field as follows:

     (a)     Two (minimum) preservation related professional or academic members to the extent that they are available;

     (b)     Two property or business owners from within the district;    

     (c)     One resident of the City.

     Members shall be residents of the City of Medina; professional or academic members may include non-residents if no qualified residents are available.  Members shall be appointed by the Mayor and approved by Council and shall serve for four-year terms.  Members shall elect a Chair and Vice Chair, each to serve a one-year term.  A staff member or designee of the Planning Department shall act as the Board Secretary.

Olmsted Falls

 1444.01  ESTABLISHMENT AND ADMINISTRATION.    

     (a)      There is hereby established in and for the City an Architectural Board of Review.

     (b)      The Board shall consist of five residents of the Municipality who shall not hold any elective office during their term on the Board and who shall be appointed by the Mayor, subject to confirmation by a majority of the members elected to Council. Each member of the Board shall serve for a term of three years, except that the original appointment of one member shall be for a period of one year, the original appointment of the second member shall be for a period of two years and the original appointment of the third member shall be for a period of three years. Any vacancy on the Board shall be filled by the Mayor, within a period of sixty days from the date of the vacancy, in the same manner as original appointments.

     (c)      All members of the Board shall have a demonstrated special interest, experience or knowledge in history, architectural history, historic preservation, architecture or related disciplines. At least two members shall have the background of architect, archaeologist, landscape architect, preservationist, historian, planner, realtor or some related field.

     (d)      At its first meeting in each year, the Board shall conduct an election for Chairperson, Vice Chairperson and Secretary. The Board may elect to have a paid Secretary. The Secretary shall keep or cause to be kept a complete and accurate record of all meetings and proceedings of the Board. Attendance of a majority of the members then appointed and qualified shall constitute a quorum. The Board shall adopt such rules and by-laws for the conduct of its business as it shall deem necessary. The Board shall meet at least quarterly and all meetings of the Board shall comply with Federal and State laws dealing with public meetings.

     (e)      All members of the Board shall be subject to State and local statutes and ordinances, respectively, regarding conflict of interest and ethics. In addition, the Board shall adopt and make public its own code of ethics that shall include a detailed conflict of interest policy for members of the Board.

     (f)      At least once a year the Board shall prepare a written report for the Mayor and Council that summarizes its activities, cases, special projects and recommendations. Such report shall be made available to the public.

     (g)      All Board documents and materials shall be made available for public inspection in compliance with Federal and State "Freedom of Information" laws and policies.

Portsmouth

    1317.05  DESIGN REVIEW BOARD.    

     The Portsmouth Design Review board, hereinafter referred to as the "Board", shall consist of five members.  The five members shall be appointed by the President of Council with the approval of Council.  All members should have to the highest extent possible a recognized knowledge of and a known interest in architectural preservation and design together with a determination to work for the overall improvement of the quality of the City's physical environment.  Of the membership, an effort should be made to nominate and appoint persons having such knowledge and interest and, in addition, some special expertise that may be of assistance in the efficient operation of the Board.  Consideration should be given to the appointment of an architect and/or other design professionals, an attorney, a licensed real estate broker, an architectural historian or any other person having special knowledge or relevance to the Board's purposes and duties.  Each appointed member shall serve a term of two years and may be reappointed for a second term, except that of the initial appointments, three members shall be appointed for a one-year term and may be reappointed for a second term of two years.  The members shall serve without compensation from the City.

Springboro

     1229.04  ARCHITECTURAL REVIEW  BOARD.

     An Architectural Review Board (hereinafter “ARB”) is hereby created to implement the purposes of this chapter by exercising the powers expressly granted and necessarily implied herein.

     (a)     The ARB shall consist of seven members appointed by the City Council.

     (b)     The members shall be:
          (1)     A member of the City Council.
          (2)     Four at-large members, all of whom shall be residents of the City.
          (3)     Two (2) residents of the City or surrounding area.  When possible, these two members should include an architect, a lawyer, a realtor or a builder, if available.
          (4)     All members shall have demonstrated special interest, experience or knowledge in history, history of architecture, or related disciplines, as well as a philosophical commitment to historic preservation through local legislation.
          (5)     At least two of the seven members should have preservation-related professional backgrounds.  This shall include the professions of architecture, history, architectural history, archaeology, planning or related disciplines.
          (6)     The City Council may deviate from the above requirements in the event that suitable volunteers with the prescribed credentials are not available.

     (c)     Terms of Office.
          (1)     The member from the City Council will serve a one-year term commencing January 1.
          (2)     The four at-large members and the two residents of the City or surrounding area shall serve two-year terms, except in the first year of existence of the ARB.  In the first year, one person from each category shall be appointed to serve a one-year term, and the other person to serve a two-year term.  Thereafter, all terms will be for two years.

     (d)     Officers.
          (1)     Each January, the ARB will elect a chairperson, a vice-chairperson, and a recording secretary from its members.
          (2)     The recording secretary shall be responsible for:
               A.     Taking and maintaining complete files of written minutes of all meetings.
               B.     Seeing to the preparation of an annual written report of ARB activities, cases, decisions, special projects, etc.

     (e)     Meetings.  The members of the ARB shall determine the time, place and frequency of meetings with the objective of providing efficient service to the public and responsive advice and other assistance to the City Council, Planning Commission and staff.  The ARB Chairman and secretary shall see that all meetings comply with the requirements of Ohio’s Open Meeting Laws, R.C. 121.22 et seq.

     (f)     Vacancies on the ARB.
          (1)     Vacancies shall be filled within 60 days.
          (2)     The chairperson will notify the Clerk of Council when a vacancy exists.

     (g)     Procedure.
          (1)     A majority of the membership of the ARB shall constitute a quorum.
          (2)     A majority of a quorum shall be required to approve any action.
          (3)     Robert’s Rules of Order will guide the conduct of the meetings.
          (4)     The agenda for the meeting will be prepared by the chairperson of the ARB, or by the assigned staff liaison, if one is assigned.
          (5)     Agenda items will be determined by contacting the Building and Zoning Inspectors, the City Manager or his designee, the City Engineer, the City Council delegate to the ARB and the Clerk of Council.
          (6)     Agenda items may include, but shall not be limited to:
               A.     Hearing of cases.
               B.     Deliberation of cases.
               C.     Findings of fact.
               D.     Approvals/denials of Certificate of Appropriateness.
               E.     Old business.
               F.     New business.
               G.     Committee reports (if appropriate).
               H.     Approval of minutes from previous meeting.
               I.     Announcements.
          (7)     At least five days before the meeting the chairperson should check with the Clerk of Council to make sure that:
               A.     Notices have been sent to applicants, attorneys, City staff members and the media as appropriate.
               B.     All applications have been properly advertised and mailed on time.
               C.     Copies of completed applications have been mailed to members, with maps and/or photographs.
          (8)     Members should make every attempt to visit each property and review each application before the meeting.
          (9)     Additional procedures may be adopted by the ARB as necessary for its governance.  All procedures so adopted shall be in writing, executed by the chairperson and secretary, and available for public inspection upon request.

     (h)     Conflict of Interest.
          (1)     Any ARB member who has a financial interest, direct or indirect, in any agenda item shall notify the ARB of that interest.
          (2)     The ARB member shall refrain from voting on or participating in any of the ARB’s discussion or debate on the issue of concern.
          (3)     Any member of the ARB who knowingly conceals such financial interest or violates the requirements of this section may be removed from the ARB by the City Council.

     (i)     Compensation and Removal.
          (1)     ARB members shall serve without compensation.
          (2)     Members may be removed by the City Council at any time without showing of cause.

     (j)     Duties and Authority.
          (1)     The ARB shall have such duties and authority as may be provided by this chapter and otherwise by ordinance, or as are necessarily implied therefrom.
          (2)     The ARB’s duties and authority shall include, but not be limited to the following:
               A.     Permitting or denying the application of the owner for a certificate of appropriateness permitting a change affecting a Protected Property.  Such approval shall be required in addition to all other permits applicable to the property.
               B.     Developing and recommending to the City Council for adoption appropriate Historic Design Standards which promote the preservation and adaptive reuse of Protected Properties.  Such standards should reflect a Historic Preservation District’s or Landmark’s historic and architectural significance; should not limit new construction within a district to any one historical period or architectural style, but rather seek to preserve the integrity and context of existing historical structures; and should promote compatible new development within the district.  The guidelines shall:
                    1.     Promote the conservation, development and use of structures, sites and districts within the City;
                    2.     Promote the special historic, architectural, community or aesthetic interest or value of the structures, sites and districts;
                    3.     Promote redevelopment of historic structures and compatible new development within Preservation Districts;
                    4.     Not limit new construction within a Preservation District or to a Landmark, but shall seek to preserve the integrity of existing historic structures;
                    5.     Take into account the impact of the designation of a structure, site, or district on the residents of an affected area, the effect of the designation on the economic and social characteristics of the affected area, and the projected impact of the designation on the budget of the City and other taxing entities.
               C.     Applying the Historic Design Standards to evaluate applications for Certificates of Appropriateness.
               D.     Making recommendations to the Planning Commission regarding amendments to this chapter and with respect to other legislation affecting Preservation Districts or Landmarks.
               E.     Establishing, within the spirit and purposes of this chapter, procedures for evaluating applications for Certificates of Appropriateness.
               F.     Considering at least the following elements in the development of Historic Design Standards:  architectural style and authenticity, structural proportion, foundation materials, exterior surfaces and their component materials, building height, building width, roof type, exterior architectural features, paving or walkways, significant landscaping features, coloring of the exterior in relation to the age and style of the structure and the coloring of the surrounding buildings.
               G.     Conducting or causing to be conducted a continuing survey of cultural resources in the community, according to guidelines established by the Ohio Historic Preservation Office.
               H.     Acting in an advisory role to other officials and departments of local government regarding the protection of local cultural resources.
               I.     Acting as a liaison on behalf of the local government to individuals and organizations concerned with historic preservation.
               J.     Working toward the continuing education of citizens within the City regarding historic preservation issues and concerns.
               K.     Reviewing all proposed National Register nominations for properties within its jurisdiction
               L.     Seeking expertise in an area when the ARB considers a National Register nomination and other actions which are normally evaluated by a professional in a specific discipline, and that discipline is not represented on the ARB (i.e., archaeology, archaeological site).
               M.     Conducting or encouraging members to attend educational sessions at least once a year, or an in-depth consultation with the Ohio Historic Preservation Office pertaining to the work and functions of the ARB or on specific historic preservation issues.
               N.     Maintaining a system for the survey and inventory of historic properties, including the following:
                    1.     The ARB shall initiate or maintain a process approved by the Ohio Historic Preservation Office for the survey and inventory of resources within its jurisdiction.
                    2.     The ARB shall maintain a detailed inventory of the designated districts, sites and structures under its specific jurisdiction.
                    3.     The ARB shall maintain securely all inventory material, and have that investory accessible to the public.
                    4.     The ARB shall maintain the inventories on Ohio Historic Inventory/Ohio Archaeological Inventory forms, or forms compatible with the Ohio Historic Preservation Office’s computerized inventory.
                    5.     The ARB shall make the appropriate inventory forms available to the Ohio Historic Preservation Office through duplicates (with contact prints).
                    6.     The ARB shall periodically update the inventory forms to reflect changes.

               O.     Establishing its own rules of procedure for, and recording, proceedings held pursuant to Section 1264.19.

Zanesville

     1105.10  DESIGN REVIEW BOARD MEMBERS.    

     (a)     The Design Review Board shall consist of seven members who meet the following criteria:  (Ord.  98-18.  Passed 1-26-98.)
          (1)     One member of Council whose term shall expire with each term of Council membership, however, the Mayor may reappoint the same Council representative if such representative is re-elected; and
          (2)     The Chairman of the Planning Commission;
          (3)     At least one resident and/or one active principal owner-operator of a business of each historic overlay district whose term shall expire every two years on December 31 to coincide with the expiration of the term of Council.  The Mayor may reappoint members when their terms expire.
          (4)     At least two preservation-related professional members (this shall include the professions of architecture, architectural history, history, archeology, planning or related disciplines) to the extent such professionals are available in the City.  One or both of these appointees may also qualify for appointment under subsections (a)(1) through (a)(3) hereof.
          (5)     All members shall demonstrate special interest, experience or knowledge in historic preservation, architecture or related disciplines and issues.

     (b)     The Mayor shall, with the advice and consent of Council:
          (1)     Appoint all members;
          (2)     Appoint a new member to fill the unexpired term of any member whose place has become vacant; and
          (3)     Fill any vacancies on the Board within sixty days, unless extenuating circumstances require a longer period.

     (c)     The members shall elect:
          (1)     One member to serve as Chairman; and
          (2)     Another to serve as Vice Chairman to serve as Acting Chairman in the absence of the Chairman.

     (d)     Council shall have the power to remove any member for cause after a public hearing is held and a copy of the charges against such member has been delivered to the member at least ten days prior to the hearing.  The member shall be given an opportunity to answer such charges.

     (e)     All successors to the original members shall be appointed for a term of five years that are staggered and shall serve without compensation.

     (f)     The Community Development Director, or his/her designee, shall serve as the Executive Secretary of the Board of Zoning Appeals.
